Important Notice

The content of this website is provided for general information purposes only. It does not constitute legal advice and should not be relied upon as such. A solicitor-client relationship arises only upon execution of a formal engagement letter. If you have a specific legal matter, please contact us to arrange a consultation.

1. Use of This Website

By accessing and browsing this website, you acknowledge that you have read and understood these Terms and Conditions and agree to be bound by them. If you do not agree, please discontinue use of the website.

You may use this website only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use and enjoyment of the site. You agree not to:

  • Attempt to gain unauthorised access to any part of the website or its associated systems
  • Transmit any unsolicited or unlawful communications through the website
  • Use automated tools to extract data from the website without prior written consent
  • Misrepresent your identity or affiliation when making an enquiry through the website

2. Legal Information vs Legal Advice

The content on this website — including descriptions of legal processes, legislative references, service descriptions, and published articles — is intended to offer general orientation about estate planning matters in Malaysia. It is informational in character.

It is not legal advice. The law, its interpretation, and its application to any particular set of facts may differ significantly from general descriptions. Decisions about your estate, Will, trust structure, or family circumstances require consideration of your personal situation, and we encourage you to consult a qualified solicitor before acting on any information obtained from this website.

No solicitor-client relationship is formed by your use of this website or by submitting an enquiry form. Such a relationship arises only upon execution of a written engagement letter between you and Pesaka Law.

3. Engagement of Legal Services

Where you instruct Pesaka Law to act on your behalf, the terms of that engagement will be set out in a separate engagement letter, which will govern the scope of work, fees, and other conditions specific to your matter. These website Terms and Conditions do not form part of that engagement letter unless expressly incorporated.

Our services are provided in accordance with the Legal Profession Act 1976 (Malaysia), applicable Bar Council rulings, and our professional obligations as officers of the court. We reserve the right to decline instructions at our discretion, including where a conflict of interest exists, or where providing the service would not be appropriate in the circumstances.

We are pleased to discuss our services, our approach, and whether we are the right practice for your circumstances before any engagement is formalised.

4. Fees and Billing

Service fees shown on this website represent our standard professional charges and are expressed in Malaysian Ringgit (RM), inclusive of our professional time but exclusive of disbursements, third-party charges, and applicable taxes unless otherwise stated.

Disbursements may include registry fees, government stamp duties, court filing fees, and third-party valuations, depending on the nature of the engagement. These will be itemised in your engagement letter and billed at cost.

Our fees are reviewed periodically. The fees applicable to your matter will be confirmed in writing before we proceed with substantive work.

5. Intellectual Property

All content on this website — including text, design, layout, and structure — is the property of Pesaka Law or its content licensors, and is protected under applicable intellectual property laws.

You may print or download content from this website for your personal, non-commercial reference. You may not reproduce, republish, distribute, or commercially exploit any part of the website content without our prior written consent.

Documents drafted or produced by Pesaka Law for your matter are delivered for your use in connection with that matter. General precedents and templates remain the intellectual property of Pesaka Law.

6. Third-Party Links

This website may contain links to external websites, including government portals, statutory bodies, and professional organisations (such as the Malaysian Bar, Amanah Raya Berhad, or the Companies Commission of Malaysia). These links are provided for reference only.

Nothing in these Terms and Conditions limits or excludes liability for personal injury caused by negligence, fraud, or any other matter that cannot be excluded by law.

8. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Malaysia. Any dispute arising in connection with the use of this website or these terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.
