Case Study — Will & Guardian Nomination
The Situation
A couple in their late thirties with two young children and a jointly-owned property had no estate documents in place. The husband's brother and the wife's parents each had different expectations about guardianship of the children, which had never been resolved formally.
Our Work
We conducted separate preliminary conversations with each spouse to understand their preferences, then a joint session to align on the guardian nomination and the distribution of the property. Mirror Wills were drafted for both. The engagement took about six weeks from first consultation to execution.
The Outcome
Both Wills were executed and registered. The family has clear, legally sound instructions for both guardianship and asset distribution. The couple described the process as "less difficult than we expected." They have since referred three other families to us.
Case Study — Intestate Estate Administration
The Situation
A retired school administrator passed away without a Will, leaving a terrace house, EPF, and savings accounts. Her three adult children were from different states and had varying degrees of legal knowledge. One child had heard that intestate estates are "very complicated" and was already anxious about the process.
Our Work
We assessed the estate and identified that the small estate summary procedure through Amanah Raya could be used for the savings, significantly reducing cost and time. The terrace house required a High Court application. We handled both tracks in parallel, keeping all three children updated by email at each stage.
The Outcome
The estate was fully administered within eleven months, divided equally among the three beneficiaries in accordance with the Distribution Act 1958. The eldest sibling wrote to say the process had been "much calmer than we expected" and that the family had all since instructed their own Wills.
Case Study — Discretionary Trust for Intergenerational Transfer
The Situation
A business owner in his early sixties held two investment properties and a minority stake in a private limited company. He wished to begin transferring assets to his children over time while retaining some control, and was concerned about what would happen to the assets if he became incapacitated before completing the plan.
Our Work
We designed a Discretionary Trust to hold the investment properties, with the client retaining a degree of influence through the trustee appointment mechanism. We coordinated with his accountant on RPGT implications for each property before any transfer was made. The company shares were addressed separately through the company's articles of association.
The Outcome
The Trust was established and one property was settled into it. The second is pending a RPGT review. The half-yearly check-ins have so far prompted one amendment to the trustee appointment to reflect a change in the family's preferred trustee. The client described it as a "living document in a way I did not expect."
